Who is responsible

What we collect

  • Business details from public sources: business name, website, logo, colors, images and text from your website, services, general contact address (like info@), phone number, location and legal form. Sources: your own website, your Google Business Profile (location and your Google rating: score and number of reviews), sometimes your public Instagram profile or the Instagram feed on your website (at most 6 photos), and public registers such as Companies House. We only contact businesses, through general addresses or the contact form on their website.
  • Progress in our CRM: for every business we contact we keep track of how it goes: country, industry, video template used, channel (email, contact form or your own request), when we made contact and when the video was viewed, responded to, taken to checkout and bought, viewing time on the preview page, number of contact moments and revenue.
  • Use of your preview page: visits, plays, clicks. No cookies and no ad networks.
  • Order details: email address, business name, address, VAT number and payment status, and what you send us through the feedback form after delivery: your notes, files you attach (such as a new logo or photos) and your voice-over script.
  • When paying by invoice also: the name of the person ordering, a registration number if you enter one, the time, IP address and browser with which you agreed, and the time and IP address of downloads. This is the evidence of the order and delivery if an invoice isn’t paid.
  • Studio requests (custom work through the form on our studio page): name, company name, email address, phone number and website if you enter them, the package you picked and your message.

Why

  • To make a sample video for your business and show it to you: legitimate interest (business outreach), or your consent if you requested a preview yourself.
  • To learn which countries, industries, templates and channels work, so we contact fewer people who aren’t interested: legitimate interest.
  • To deliver your order, process your feedback and invoice you: performance of the contract and legal retention duties.
  • To collect an invoice, with reminders and if necessary through a collection agency, attorney or bailiff: legitimate interest (getting paid what was agreed).
  • To answer your studio request and send a quote or intake: your consent and steps prior to entering a contract.

Your price. Everyone in the same market pays the same price. We don’t use data about your business to set your price, and no automated decision is made about you.

How long

  • Your preview page and video are online for 28 days, counted from our first message. After that they go offline.
  • Without a purchase we then delete the preview, video, email address, phone number, address and postcode, images and text (including replies to our email), no later than 30 days after publication. Only the preview code stays, so the unsubscribe button on the page keeps working.
  • After that our CRM keeps only the domain, country, region, industry, legal form, template, channel, timestamps and outcome. No email address, phone number, images or text. That way we don’t contact you twice and we learn what works.
  • We keep that CRM record for 24 months after the last contact, or 12 months for a sole trader or when we don’t know the legal form. After that we replace the domain with an irreversible code (hash) and keep only counts without business details.
  • Suppression list: if you unsubscribe or have everything deleted, your domain and email address stay on a suppression list, so we never email you again. If you didn’t respond to our emails, we don’t contact you again either. After the CRM period above we only remember this as a hash.
  • Invoices and order details: 7 years (tax law).
  • Studio requests that don’t lead to an order: 12 months after our last contact. You can have them deleted sooner.

Who we share data with

Only service providers we need, under a data processing agreement: hosting and database (Supabase, EU), video hosting (Bunny Stream, EU), payments and invoices (Stripe), email delivery, fetching websites, and speech synthesis for voice-overs (ElevenLabs). If an invoice is still unpaid after the final notice, we share the order and business details with a collection agency, attorney or bailiff, where necessary in your business’s country. Sample videos on our studio page are hosted on YouTube; they only load when you click play (through youtube-nocookie.com). We never sell data.

Your rights

You can access, correct or delete your data and object to processing, including the progress in our CRM. Unsubscribe right away with the ‘Stop emails’ button on your preview page, or at encircle.tv/en/unsubscribe. To have everything deleted right away, use ‘Delete video and data’ on the same page. Other requests: info@encircle.tv. You can also complain to a data protection authority: the Dutch Autoriteit Persoonsgegevens, the Information Commissioner’s Office (ICO) in the UK, or the authority in your own country.
